Township Council Passes Ordinances

The Livingston Township Council passed two ordinances and introduced two ordinances, at its Monday, March 27, regular meeting. Several resolutions also passed, which included the approval of several contracts, waiving outstanding taxes for certain properties, and changing fees for certain events in town.

Several resolutions also passed, which included the approval of several contracts, waiving outstanding taxes for certain properties, and changing fees for certain events in town.

Ordinances Introduced

An ordinance was introduced to eliminate split lot zoning on two parcels of land in town, block 4302 lot 10 and block 4801 lot 9.

Block 4302 lot 10 is located along South Livingston Avenue and Amelia Avenue. Most of it is currently in the commercial B-1 zone, with a portion zoned for R-4, which is used as a parking lot servicing the commercial zone. The ordinance wouldmake the entire lot in the B-l zone.

Block 4801 lot 9 is an over three acre parcel located along West Harrison Place, Collins Terrace, and West Northfield Road. It is currently in the commercial B zone, with a portion zoned for R-4, which is also used as a parking lot servicing the commercial zone. The ordinance wouldmake the entire lot in the B zone.

Another ordinance was introduced to permit monument signs on certain eligible properties in the B and B1 zones on the township zoning map. The ordinance would permit certain storefronts located perpendicular to their street frontage to install signs along the main roadway.

These ordinances will next be heard on second reading on April 24.

Ordinances Pass

Two ordinances were passed, both related to 346 East Cedar Street, known as block 7300, lot 4.02 on the township tax maps and owned by Livingston Alf Amprop, LLC. The property is the subject of preliminary and final site plan approvals, minor subdivision approval and bulk variance approval. The approvals allow for the construction of an assisted living facility, a post-acute rehabilitation center, ancillary parking and other related improvements on the property.

As part of the approvals, the company is required to file both a deed restriction to impose certain affordable housing obligations on the property; and a perpetual non-exclusive easement to the township to allow for maintenance, repair and replacement of utilities, primarily water and sewer lines.

The first ordinance accepts a utility easement on the property, while the second accepts a deed restriction. Both were passed unanimously.

Outstanding Taxes

Resolutions were passed to cancel the outstanding taxes for 200 South Orange Avenue and 12 Industrial Parkway ($75,001.08). The South Orange Avenue property, Saint Barnabas Ambulatory Care Center, is tax exempt, while the Industrial Parkway property was acquired by the town in 2020. Both were on the tax roll in error, according to town officials.

Contracts

The Council approved several contracts.

24-month contracts were agreed to with Atlantic Coast Polymers, George S. Coyne Chemical, Main Pool Chemical Company, Univar Solutions USA, and USALCO, for the purchase of water treatment chemicals.

A $496,732.70 contract was awarded to Stanziale Construction, for the two-inch milling and paving of section two of Belmont Drive.

A $590,400.43 contract was awarded to Ischia Corporation for road improvements to RoyalAvenue.

A $705,430.79 contract was awarded to JCT Solutions for camera systems, door access, data switches, and Wi-Fi. This contract is expected to cover the installation of security cameras for the electronic recycling dropoff behind the Senior/Community Center.

Event Fees

A resolution was passed to establish various event fees. For “Level 1” events, the township will partially sponsor the event and cover a percentage of the costs. For “Level 2” events, the event producers are responsible for all costs, including staffing and equipment fees.

Closed Session

At the end of the meeting, the Council went into a closed executive session. The Council was expected to discuss the Livingston Mall tax appeal; public safety; 70 South Orange Avenue related to Fair Share Housing; West Hobart Gap potential development; 132 and 142 South Livingston Avenue redevelopment opportunities; and contract negotiations.
