Cases Heard in Livingston Municipal Court

A number of cases were heard in Livingston Municipal Court this past week, including a DWI and an instance of shoplifting from Ulta Beauty.

A number of cases were heard in Livingston Municipal Court this past week, including a DWI and an instance of shoplifting from Ulta Beauty.

DWI

Anne Galluzzi, 62, of Boonton, was charged with a DWI on June 24.

Galluzzi was additionally charged with careless driving, having an open container of alcohol in a motor vehicle, consuming said open container of alcohol in a motor vehicle, and delaying travc. All charges excluding the DWI were dismissed as part of a plea agreement. Galluzzi was .ned $507 and ordered to pay $33 in court costs; $75 for the Safe Neighborhoods Fund; and $50 for the Victims of Crimes Compensation Organization (VCCO). Additionally, she was or - dered to pay a $225 DWI surcharge.

Her license was revoked for one year, and she must have an interlock system for two years following the suspension. She was also told to report to the Intoxicated Drivers Resource Center (IDRC) for 48 hours. In addition, she was sentenced to two days in jail, to be served at the IDRC. Galluzzi was also ordered to complete 30 days of community service.

Prohibited Work Time

The Irvington-based company Fuentes General Construction was charged with using an excavator during a prohibited time on Sunday, July 14.

The company pled guilty and received a .ne of $100. They were additionally ordered to pay $33 in court costs.

Attempted Theft

James Riley, 30, of Newark, re ceived three charges in assocation with an event that took place on January 19, 2023.

He was charged with attempted theft for entering a 2021 BMW X7 at Livingston Circle Car Wash in an attempt to steal it. He was also charged with burglary and conspiracy to commit theft.

This case was reviewed by the Es- sex County proscecutor's ovce and downgraded to two charges of theft and one charge of de.ant trespassing. Riley pled guilty to the .rst charge of theft, and the other two charges were dismissed as part of a plea agreement.

He was .ned $1,000 and ordered to pay $33 in court costs; $75 for the Safe Neighborhoods Fund; and $50 for the VCCO. Riley was also sentenced to 174 days in jail, with 174 days credited.

Shoplifting

Saduqia Mitchell, 29, of Roselle, faced .ve charges in association with an incident on January 11.

She was charged with shoplifting from Ulta Beauty, speci.cally per fumes and makeup items valued at $1,308.27. She was also charged with conspiracy to commit shoplifting. Since she was found to be in possession of a stolen New Jersey driver’s license, she was also charged with receiving stolen property, being in possession of a stolen New Jersey ID, and hindering apprehension by falsely stating the ID belonged to her sister.

The shoplifting charge was downgraded to an amended charge of theft, for which she pled guilty. All other charges were dismissed as part of a plea agreement. She was sentenced to 96 days in jail, with 96 days credited, and ordered to pay a $1,000 fine, plus $33 in court costs; $75 for the Safe Neighborhoods Fund; and $50 for the VCCO.

Burglary

Julio Ocampo-Valdes, 36, of Maspeth, NewYork, faced numerous charges in association with an incident that took place on February 2.

Ocampo-Valdes was charged with burglary by entering the residence at 12 Montgomery Road in Livingston. He was also charged with criminal mischief for breaking a glass entryway door and with being in possession of burglary tools.

Upon review by the Essex County proscecutor’s office, the burglary charge was downgraded to criminal trespassing and the criminal mischief charge was downgraded to a disorderly persons grade charge of disorderly mischief. Ocampo-Valdes pled guilty to criminal trespassing and entered into a conditional dismissal program.

He was ordered to pay a $1,000 assessment fee; a $75 conditional dismissal fee; $33 in court costs; $75 for the Safe Neighborhoods Fund; and $50 for the VCCO.
